Removal Deferral Requests

Clear advice, careful preparation and professional representation for your Canadian immigration matter.

A request to defer removal asks CBSA to postpone enforcement for a limited period based on circumstances that fall within the officer’s lawful discretion. It is an exceptional, fact-specific remedy and should be supported by focused evidence.

Potential considerations

  • Short-term risk or significant new developments
  • Best interests of affected children
  • Medical or practical impediments to removal
  • Imminent determination of another proceeding where legally relevant
  • Whether removal arrangements create exceptional hardship within the applicable legal framework

A deferral request does not itself guarantee that removal will be postponed.
