Removal Deferral vs Federal Court Stay of Removal
· Harjeet Arora, RCIC-IRB
A request that CBSA defer removal and a motion asking the Federal Court to stay removal are different procedures. They should not be treated as interchangeable.
CBSA removal deferral
A deferral request asks the enforcement authority to postpone removal based on circumstances that are legally relevant to the enforcement decision. The scope of what CBSA can consider is not unlimited.
Federal Court stay
A stay of removal is judicial relief. It is generally sought in connection with a Federal Court proceeding and requires the applicable legal test to be met. Filing a court case does not by itself mean removal is stayed.
Why timing matters
Both remedies can become urgent once a removal date is fixed. Counsel needs the removal documents, underlying decision, litigation history and evidence early enough to assess the correct route.

Keep the remedies distinct
A CBSA deferral request is addressed to enforcement authorities; a court stay requires judicial consideration. Neither remedy should be assumed available without reviewing the decision, timing and supporting evidence.
