Canada’s International Mobility Program includes LMIA-exempt work-permit categories for certain foreign nationals whose work may create a significant economic, social or cultural benefit to Canada. These applications are highly fact-specific and generally require more than simply showing that the applicant is qualified for the proposed work.
Significant benefit assessment
The application should explain the proposed activity in Canada and demonstrate why the applicant’s background, achievements, expertise or business activity creates a benefit significant enough to justify an LMIA exemption. The evidence required varies considerably depending on the category and circumstances.
Entrepreneurs and specialized professionals
Significant-benefit provisions may arise in cases involving entrepreneurs, self-employed business operators, specialized professionals, researchers, artists, cultural workers and other applicants whose proposed Canadian activity can be supported by objective evidence of benefit.
Officer discretion
These applications involve substantial officer assessment. A business plan or job offer alone may not establish significant benefit. The supporting record should connect the applicant’s credentials and proposed activities to concrete Canadian benefits.
