Regulated Canadian Immigration & Refugee Counsel

Canadian Immigration Counsel

Immigration Appeal Division (IAD)

Clear advice, careful preparation and professional representation for your Canadian immigration matter.

The Immigration Appeal Division of the Immigration and Refugee Board hears specified immigration appeals, including eligible sponsorship refusals, removal order appeals and residency obligation appeals. Jurisdiction and deadlines must be confirmed before an appeal is started.

What we assess

  • Whether a statutory right of appeal exists
  • The filing deadline and completeness of the appeal record
  • Legal errors and factual findings in the underlying decision
  • Documentary and testimonial evidence required for the hearing
  • Humanitarian and compassionate factors where the IAD has equitable jurisdiction

Representation before the IAD

Preparation may include disclosure, witness preparation, documentary evidence, legal submissions, alternative dispute resolution where offered, and representation at the hearing.
