Eligible refugee claimants may appeal a negative Refugee Protection Division decision to the Refugee Appeal Division. RAD proceedings are generally record-based and strict filing requirements apply.
What we review
- Whether the claimant has a statutory right of appeal
- Notice and appellant record deadlines
- Errors of fact, law or mixed fact and law
- Admissibility of proposed new evidence
- Whether an oral hearing may be warranted
The appeal memorandum should identify material reviewable errors rather than simply repeat the refugee narrative.
